Senate Fails to Advance Clarity Act in 49-50 Cloture Vote | Regulation Blockchain

The U.S. Senate on Tuesday voted 49-50 against advancing the Digital Asset Market Clarity Act, falling short of the 60 votes needed to end debate and move the sweeping crypto market-structure bill toward a final passage vote. The failed cloture tally, recorded on the bill’s official docket on September 15, closes the measure’s realistic path in the 119th Congress and hands the crypto industry its most consequential legislative defeat of the year. The procedural setback arrived after a months-long lobbying campaign that had made the bill the sector’s top priority in Washington.

A Market-Structure Bill Stalls at the Threshold

The measure — H.R. 3633, championed by Senators Tim Scott, Cynthia Lummis and John Boozman — would have established a federal framework that divides oversight of digital assets between the Commodity Futures Trading Commission and the Securities and Exchange Commission, largely along a decentralization test. Sponsors positioned the CFTC to regulate bitcoin and other sufficiently decentralized assets as commodities, while the SEC would retain authority over more centralized projects. Proponents argued the split would end a years-long jurisdictional standoff and give issuers and exchanges a clear compliance path. Under Senate rules a cloture motion requires 60 votes, and Tuesday’s 49-50 result left supporters eleven votes short.

Ethics Demands and the Trump Factor

The vote collapsed amid a standoff over ethics provisions. Democrats, led by critics including Senator Elizabeth Warren, pressed for stronger limits tied to President Donald Trump’s personal digital-asset holdings, while Republicans rejected a late counter-proposal. The impasse left the bill without the bipartisan support it needed, echoing the state-level resistance already voiced by New York Attorney General Letitia James, who led 17 states in opposing the bill over concerns it would preempt state fraud enforcement. The clash followed the GENIUS Act stablecoin law, which took effect in 2025 and remains the sector’s main federal on-ramp.

    Regulators and the Industry Regroup

The outcome had been telegraphed in advance. CFTC leadership had already put staff on notice to build crypto rules if the Clarity Act failed, signaling that an agency-led rulemaking path could now accelerate in the bill’s absence. Bitcoin and crypto-linked equities slipped after the tally, extending losses that began ahead of the vote. For the industry, the defeat pushes a federal market-structure framework further out of reach until at least a new Congress, leaving firms to navigate a patchwork of enforcement actions, state rules and court-driven precedent in the interim.
